If scurvy existed today, he argued, regulators would deny the obvious. “The FDA would be telling us no vitamin C… we’re going to give you drugs to straighten out your bones or to tighten your teeth. And how do I know that? Because that’s what they’ve been doing with cancer, to the detriment of millions of Americans.”
When many of us think of medicine and pharmacy, we associate it with helping the sick. And indeed, when you go to the doctor with the symptoms of an illness, you are given a prescription for a drug that will alleviate those symptoms. However, this is by no means a real treatment that will cure your illness. Cured patient = lost customer.
Imagine that you are theoretically the CEO of a large pharmaceutical company and your primary legal duty is to ensure the economic growth of your company. You may be a noble person and care about people’s suffering, but this conflicts with your primary duty.
The economic growth of the organization you lead depends primarily on increasing patient numbers. If you allow the moral aspects to outweigh the economic aspects, you will quickly lose your position and your assets, and you may also go to prison for defaulting. I remind you that the board of directors of a listed company must first and foremost ensure that the dividends paid to shareholders are maximized.
That is the system we have. The lack of effective controls is the real cause of the countless cases of fraud in the pharmaceutical industry. Pharmaceutical companies have been repeatedly convicted in court for massive fraud. Large fines have been imposed, usually as a result of settlements, but no CEO has ever been imprisoned for defrauding their own customers.
